While all translation involves rendering written content from one language to another, with legal translation there’s an added complication: the final document has to say the same thing and have the same legal effect in another language and another jurisdiction 

Even small details such as dates and timelines can affect legal enforceability. A confidentiality clause that requires information to be kept confidential for “five years after disclosure” may be mistranslated as simply “five years.” Without the reference to disclosure, the start date becomes unclear, which can shorten or extend the obligation and create legal uncertainty. 

Types of Legal Documents That Require Translation

 1. Contracts and Agreements 

The practical purpose of contract translation is to protect what each side agreed to – clearly and reliably, protecting each party’s rights and obligations. This applies equally to everyday documents such as terms and conditionsemployment contracts, or NDAs, as well as to more complex paperwork like shareholder agreements, licensing, and partnership contracts. How Legal Translation Works (Step by Step)

Step 1 — Review the document and purpose (where it will be submitted) 

Every legal translation starts with understanding the document’s purpose and destination. Different countries (and sometimes, even different regions within them) have their own jurisdictions and legal protocols.  

This means that, while an experienced French legal translator may be fully aware of the legal system in France, they may be less well equipped to work on a legal document destined for French-speaking Switzerland – despite fully understanding the language. A large part of legal translation is the ability to navigate the judicial system of the destination country.  

Once the document’s purpose has been fully understood, the project manager will then confirm whether certification or notarization is required, and also carry out some initial checks, verifying, for example, that all parts are legible, complete, and bear the necessary stamps and signatures. 

Step 2 — Assign a legal specialist translator 

Once these preliminary checks have been carried out, the second step is to assign a legal specialist translator to the project. The project manager assigns a linguist with experience and expertise in the required legal domain.  

The field of law is sufficiently broad that different legal translators may well be unfamiliar with significant parts of it: a contracts translator, for example, won’t necessarily be familiar with court pleadings or the nuances of intellectual property law.  

Step 3 — Terminology research + consistency control

The workflow for legal translation is designed to protect your documents’ legal meaning and satisfy acceptance requirements. It begins with careful terminology research to ensure all terms match their intended legal effect.  

These terms can then be compiled in a working glossary. This should include the source wording, as well as the preferred translation to preserve consistency throughout the document.  

A short definition can also be useful, particularly when multiple linguists are working on the same document or project. Note down formatting preferences for names, dates, numbers, and conventions for citations, for example whether the document follows The Bluebook style.

Step 4 — Edit + second-linguist review + proofreading

The editor performs the first pass for substance and style. This involves checking for accuracy, tone, and that the translation reads like a single voice.  

The second-linguist review is mainly focused on meaning, ensuring the translation carries the same legal implications as the source document.  

Finally, a third safety net – in the form of a meticulous proofreader – tidies up any formatting issues, and combing through the tiny details like numbering, pagination, and adherence to the style sheet, plus any last-minute consistency checks. 

Step 5 — Prepare certification/notarization package (if required)  

If the document requires certification or notarization, there should be a one-page certificate of accuracy and completeness.  

This statement should be signed and dated by the linguist, and bear either the agency’s corporate stamp or the individual translator’s contact details and professional affiliations.  

If notarization has been requested, the agency should also arrange for a notary to witness the signature. This notarized page can then be attached to the final file. 

Step 6 — Secure delivery and revisions if needed

The final step is to send over the files to the client in whatever format they requested. This might be an editable Word document, a locked PDF, or a scanned copy of a signed notarization. 

Once the documents have been sent over (always using an encrypted, secure channel), that may be the end of the process. Alternatively, the client might request some revisions. It’s best to agree how this will work in advance (say, two rounds over 7–10 days).

Another consideration is the importance of consistency. Once a term has been selected (for example, to signify a term that cannot be literally translated), use it everywhere. 

2. Different legal systems (common law vs civil law)

The same term can carry wildly different baggage depending on the legal tradition: consideration in a common-law contract isn’t the same creature as a similarly worded concept in civil-law jurisdictions.  

A translator’s job is therefore to recreate the effect, not the words. This involves choosing target phrasing that a local lawyer will read as having the same legal consequences and flagging any unavoidable shifts in meaning.

One thing it’s essential not to overlook is the admin details, in other words, the seemingly insignificant parts of a document that make it “official.”
